Record label execs might be better off banging their heads against the Great Wall of China; at least that way, they'd see and feel something of historical significance. But in what's likely to be an equally unproductive move, they've instead decided to sue Baidu again.
On January 3rd, we reported that EMI, SONY BMG, and Universal Music had lost a lawsuit against the Chinese search company. Yet Yahoo China also lost a case, and it's by that new precedent that Sony BMG, Universal Music, and Warner Music are hoping to win the latest round.
As we ever-so-delicately hinted earlier, however, that seems unlikely. Chinese courts have been pretty kind to Baidu, and even if the ruling goes against the company, any penalty will probably amount to less than a slap on the wrist. And then there's the matter of whether Baidu would even pay fees or change anything.
Kelly Fiveash reports that Yahoo didn't. "Yahoo! China can also expect legal action, said the IFPI [International Federation of the Phonographic Industry], after it refused to budge on a landmark ruling in December . . ."
So once again, we have a situation that is sure to suck funds out of every involved company, and may be resolved as quickly as the Chinese court can process the paperwork. Right or wrong, the record companies need to find something better to do with their time.
