"You win some, you lose some" may well be Facebook's unofficial motto.  Even as word spread this morning that the company had tried and failed to acquire Twitter, there's fresh news that a spam lawsuit led to it being awarded over $873 million in damages.

Judge Jeremy Fogel ruled that Adam Guerbuez and Atlantis Blue Capital violated the CAN-SPAM Act, and should pay Facebook the huge sum as a result.  Court costs may get tossed in, too.

 

On the Facebook Blog, Max Kelly, the company's directory of security, responded by saying, "It's unlikely that Geurbez and Atlantis Blue Capital could ever honor the judgment rendered against them (though we will certainly collect everything we can)."

But Guerbuez and Atlantis Blue Capital are also supposed to stay away from Facebook and its users in just about every way imaginable, and Kelly continued, "[W]e are confident that this award represents a powerful deterrent to anyone and everyone who would seek to abuse Facebook and its users."

The statement seems fair enough - spammers are trying to make money, not get sued into homelessness.  Facebook users should cross their fingers and hope for a tangible effect as we head into a prime shopping and spamming season.
