The European Court of Human Rights has rejected the appeal of British hacker Gary McKinnon, opening the door for him to be extradited to the United States within weeks.
McKinnon is accused of carrying out "the biggest military hack of all time" and could face up to 70 years if convicted in the U.S. for hacking the computers of the Pentagon, U.S. army, navy and NASA which caused $700,000 worth of damages. McKinnon has said he was searching for evidence of U.F.O.'s
"The appeal is lost," Karen Todner, a lawyer for Mr. McKinnon, said, according to Reuters. "He is completely distraught, all of them are, his family, his girlfriend."
McKinnon had asked the European Court of Human Rights to prevent his extradition to the U.S. arguing that he could face inhumane prison condition if found guilty here.
Todner said McKinnon would appeal to Home Secretary Jacqui Smith to try to convince her to reconsider a previous decision to prosecute her client in the UK. She said if that fails he would likely be extradited to the U.S. within three weeks.
She said her client had recently been diagnosed with Asperger's Syndrome and hoped Smith would consider that information.
McKinnon lost his appeal in July in Britain's highest court, the House of Lords, which ruled the seriousness of the charges would carry a maximum life sentence under English law.
McKinnon's lawyers in that case said it was not handled properly by prosecuting authorities. "We believe that the British government declined to prosecute him to enable the US government to make an example of him. American officials involved in this case have stated they want to see him 'fry.'"

How can they justify the claims of those kinds of damages?
The only damage he's caused is huge embarrassment to the US Government who's systems were so poorly "secured". They are just trying to cover up the embarrassment with claims of it being "the biggest military hack of all time". It's a joke - give the guy a bloody job I say!

Without more details on the story, I would say that his extradition points out that what he did was wrong, but as "Blockbuster" points out, he has displayed flaws in our security. Maybe we should think about community service and put this guy to work!
Needs to be punished
I agree that he needs to be punished by the US. The amount of punishment, should be up to the law and not by this blog. We, here, do not have all of the evidence and have not been in a court room listining to the testomony. Flawed as it may be, the system in the US IS a good system and he will be allowed to have representation, that will speake for him. And yes....he will be allowed to speake for himself.
What other country allows this type of justis??? How many counties would just shot him and call that justis???
Thank God we still have justis and allies as Britain, that also understands, what "illegal" means.

The law about hacking i dont entirely agree with as far as govt systems are concerned. Invasion of private home computers is bad. But with military and national security setups there is no excuse for failing to secure against a lone hobbyist hacker.
It is the so called professionals who develop and maintain these that should be prosecuted. Of course an event such as this occuring causes acute embarrassment to the high flying son of a gun/s such as you americans like to portray as saviours of the world and conquerers of all evil.
There was a movie similar to this scenario where a young lad (you would say kid) nearly started ww3. All those lit up screens in a huge darkened complex with all those overdecorated generals and big cigars shouting rude comments and "by god we mean it" orders to uniformed guys with lesser and not as big badges and medals etc.
I am an Aussie and have to say "sorry guys you failed". Hard luck the Brit.

That sort of punishment seems a bit harsh, I agree that hes definatly pointed out some flaws within their systems.

Harsh to punish a guy who actually pointed out some serious flaws in their own security.
He didn't do anything malicious to the computers or the systems even though they are claiming ridiculous damages. The damages are just them having to beef up their own security.

Asperger's syndrome is a recognised neurological disability and people with Asperger's are vulnerable adults with very immature outlook and trusting nature. They are driven by their obsessions developed in response to bewildering social environment they cannot understand. It's not something someone can 'snap out of' - Autism is for life and no support makes co-morbid conditions of Autism worse. Gary is disabled - he's not a terrorist. It's despicable how they are throwing this vulnerable man to the mercy of power-mad war-mongering US authorities.
