Nicole “Snooki” Polizzi from the reality television show, “Jersey Shore”, has filed a six million dollar lawsuit against a company that she says has ripped off her brand of perfume, taking away from her original scent. She is also requesting that the court stop the sales of the other perfume immediately.
The suit was filed against Excell Brands, based in New Jersey, and is accusing their new perfume “Snazzy” of copying Polizzi’s official “Snooki” and “Snooki Couture” fragrances.
“Without ever seeking, much less obtaining, Ms. Polizzi’s permission or consent, [Excell] disseminated its products and brands containing Ms. Polizzi’s name, likeness, signature and identity,” the suit says.
The “Snazzy” perfume has many similarities to Polizzi’s brand including the font used for it’s name on the bottle. Also, on the the bottle, it says that their perfume is “our version of Snooki by Nicole Polizzi.”
25-year-old Polizzi released her first fragrance in 2011 and has been very successful with it and her other ventures that she has taken on so far. The lawsuit actually has a page dedicated to Snooki’s accomplishments. The suit states: “Polizzi has achieved considerable commercial success in her career by, among other things, maintaining strict control over the projects and commercials endorsements with which she is associated.”
The suit also serves as a marketing tool for Polizzi stating that, “customer reviews of Plaintiff’s official perfume rate it highly and often recommend it.” You can purchase a bottle of Polizzi’s perfume for “list price for a 3.3 oz. bottle is $45” and that “customer reviews of Plaintiff’s official perfume rate it highly and often recommend it.”
Calls to Excel and to Snooki’s lawyer, for a comment, have not yet been returned.
