Lamar Odom likely won’t face drug charges from the day he was found unconscious in that Nevada brothel. Odom’s blood revealed he had accidentally overdosed on cocaine that day, and the sheriff on duty at the time said there was a chance he would be prosecuted for cocaine possession.

Now it seems the Nye County, Nevada D.A. is disregarding the sheriff’s statement.

TMZ reports the reason the D.A. isn’t moving ahead with prosecuting Lamar Odom is because of his medical condition and mental state. They also report that Lamar is barely able to speak right now, and he can’t walk either. His cognitive functions are in rough shape, too.

Lamar Odom has remained hospitalized since being moved from Las Vegas to Cedars-Sinai Medical Center in Los Angeles last month. There is some question as to whether he’s even competent enough to stand trial if charged.

Khloe Kardashian had been by Lamar Odom’s side almost constantly since he was first hospitalized in Las Vegas. She was treated for a staph infection she likely acquired in the hospital and had to stay away from the hospital for a while. She reportedly returned to visit Lamar in the hospital the day after Thanksgiving.

Lamar Odom is unaware of how close he came to death or how he came to be in his present condition.

“We tell him he had a brain injury, (but) I can’t tell him how that brain injury was caused, because it will set him back,” Khloe Kardashian told Ellen DeGeneres recently. “He’s never asked why he’s here.”
