Josh Duggar was turned down by a judge following his request to dismiss the $500,000 lawsuit filed against him by porn star Danica Dillon.

Dillon, whose real name is Ashley Stamm-Northup, filed the suit against Josh Duggar, claiming he caused her “physical and emotional injuries” when they met up for sex. Duggar admits he paid for sex with Danica Dillon, but denies he caused her any harm.

“He threw me on the bed and, in all honesty, though it was consensual it more or less felt like I was being raped,” Dillon states in the lawsuit. “I never said no, I am going to have to reiterate that, I never told him no. But I did push him back and push him off and say that’s too rough that’s too rough.”

Josh Duggar’s attorney filed a motion on his behalf on December 30, arguing Danica Dillon “did not provide anything more than a formulaic recitation of the elements of assault and/or battery.”

“Her labels and conclusions are not adequate, particularly because she states that she consented to physical and sexual contact in exchange for payment,” the motion stated.

Josh Duggar admitted this summer–after he was outed during the Ashley Madison cheater’s website hack–that he cheated on wife Anna Duggar and has an addiction to pornography. He entered a faith-based rehab facility in Illinois in August, and has remained there since then. He is supposedly receiving treatments for his “sexual sins.”

Now that a judge has denied Josh Duggar’s motion to dismiss Danica Dillon’s lawsuit, the former 19 Kids and Counting star has until January 20 to answer to those charges.

Meanwhile wife Anna Duggar is back home in Arkansas, raising the couple’s four children as though she was a single mom. Despite pleas on behalf of some of her family members to divorce Josh Duggar, she seems determined to stay and work things out.
