Jared Fogle: Prosecutors Want 12.5-Year Max Sentence

Former Subway sandwich slinger and admitted child pornographer/molester Jared Fogle is facing a 12.5 year sentence if prosecutors have their way.

In August, Fogle agreed to plead guilty to one count of traveling to engage in illicit sexual conduct with a minor and one count of receipt of child pornography. His lawyers are asking for leniency, suggesting a five-year sentence for Fogle.

But according to reports, prosecutors will try for 12.5 years – the maximum allowed per Fogles’ plea agreement.

The AP reports that the judge could impose an even harsher penalty if she choose. “The child-porn charge carries a maximum 20 years in prison, and the sex with a minor count is punishable by up to 30 years.”

The Jared Fogle news broke in July, when police raided his home looking for digital evidence of child pornography. Officials say that Fogle had Russell Taylor, the head of his nonprofit organization, secretly record minors and send him the photos/videos. Twelve minors are said to be involved, some as young as 12 years old. Fogle also traveled across state lines to engage in sex acts with at least one minor.

The disgraced former face of Subway is currently paying out $1.1 million to 11 of his victims.

Some have spoken out, saying Fogle’s 5-12 year possible sentence isn’t harsh enough.

“Given the facts of the case and the severity of what he did, we believe the sentencing range is appropriate,” said Tim Horty of the U.S. Attorney’s Office. Fogle may get supervised visits with his children as part of the plea deal if his wife agrees to it. she filed for divorce shortly after Fogle’s crimes came to light.

According to Fogle’s attorney, he is “profoundly sorry” for what he’s done.

“Jared also knows that he has a medical problem. He has already sought evaluation by a world class psychiatrist, experienced in these matters and he wills seek appropriate treatment. Fogle knows that restitution can’t undo the damage that he’s done,” said defense attorney Jeremy Margolis.
