The New Mexico Lawsuit and the Broader Legal Reckoning

The emails came to light through discovery in a lawsuit filed by the state of New Mexico, which accused Meta of failing to protect children on its platforms. What the Emails Mean for the Future of Platform Accountability

The disclosure of Zuckerberg’s emails arrives at a moment of significant regulatory flux. In the United States, the Kids Online Safety Act has gained bipartisan momentum in Congress, and the Federal Trade Commission has proposed new rules that would restrict how technology companies collect and use data from minors. In Europe, the Digital Services Act has imposed new transparency obligations on large platforms, including requirements to assess and mitigate systemic risks to minors. Against this backdrop, evidence that Meta’s CEO contemplated scaling back internal research on child safety is likely to intensify calls for mandatory, independent auditing of platform effects on young users.

For Meta, the strategic calculus has shifted considerably since 2021. The company has made a series of public commitments to teen safety, including default privacy settings for minors on Instagram, restrictions on direct messaging from adults to teens, and the introduction of parental supervision tools. The Deeper Question Silicon Valley Cannot Escape

The tobacco industry faced a similar dilemma decades ago, and the eventual answer—imposed by regulators and the courts—was that companies could not hide behind ignorance, willful or otherwise. The parallel is imperfect, but it is instructive.

Mark Zuckerberg’s private frustration with the asymmetry of scrutiny between Meta and Apple is, in one sense, understandable. No CEO relishes being the primary target of a societal backlash. But the remedy he appeared to contemplate—reducing the company’s own capacity to understand the effects of its products—would have moved Meta in precisely the wrong direction. The emails, now part of the public record, will likely serve as Exhibit A in the argument that voluntary self-regulation by technology companies is insufficient, and that only external mandates can ensure that the pursuit of profit does not come at the expense of the most vulnerable users.
