The Ninth Circuit Court of Appeals upheld prior decisions today that Prop 8 (the banning of gay marriage in California) is unconstitutional.

The line of logic the court employed is that a right had been granted to same-sex couples to marry in California, and a right can not be rescinded just because a simple majority of voters say so.

The case will now likely be appealed to the US Supreme Court, but for now, Prop 8 opponents are celebrating. And backers are fuming:
