    The 63-year-old Independence Day actor sued the suburban Indianapolis company American Surety in Hamilton County Court on April 10 for allegedly posting bail for Quaid and his wife, Evgenia, on two occasions without the couple’s consent, leaving them responsible to pay for $50,000 in bonds they had not requested.

    The first occasion occurred in September 2010, when Quaid and his wife were charged with burglary on suspicion that they were living in the guest house of a Montecito, Calif., home owned by Warner Bros. executive Bruce Berman without permission. Authorities said at the time the Quaids were suspected of causing more than $5,000 in damage. According to documents filed in Hamilton County Superior Court, Quaid disputes Berman’s ownership of the home, saying Quaid’s family, which at one time owned the home, never transferred the deed to Berman’s name.

    A month later, the Quaids were detained by immigration police in Vancouver after a California judge issued a bench warrant for their arrest. They missed a hearing scheduled for Oct. 18, 2010. However, the Quaids said they were never notified that a court date had been set.

    According to court papers, the Quaids did not give American Surety their consent to post two bonds for $50,000 on their behalf.

    “The Quaids believed that criminal charges were no longer being pursued and that their release was not procured via bonds posted, but because the charges were dropped and the issue would proceed instead as a civil matter between Mr. Berman and the Quaids,” attorney Michael Einterz Jr. wrote in the court filing.

    “The Quaids did not enter into a written agreement with American or its agent to provide the $50,000 bonds and did not agree to pay any sums to American or its agent in exchange for the bonds,” the court papers said.

    The bonds were forfeited a month later when the couple did not attend a Nov. 2 hearing, leaving the Quaids on the hook for repayment, the company contends.

    Again, the Quaids say they did not know about the hearing or the bonds. The couple was released by immigration because Evgenia Quaid’s father has Canadian citizenship.

    The Quaids are seeking unspecified damages for lost wages and emotional distress.

    Quaid, the older brother of actor Dennis Quaid, is a character actor best-known for supporting roles in films such as National Lampoon’s Vacation (1983), Kingpin (1996), and Brokeback Mountain (2005).
