    The sentencing phase of her trial ended in a deadlocked jury that couldn’t decide on life in prison or the death penalty.

    Therefore, a new jury has been selected to decide Jodi Arias’ fate, but a battle has been brewing in the background over the decision by the court to release the transcript of her closed-door testimony to the public.

    Her lawyers are appealing the decision, and Arias wanted the sentencing phase to halt while the appeal was made, but that bid was denied.

    Maricopa County Superior Court Judge Sherry Stephens said on Thursday that she wouldn’t rule on a request by news organizations to release a transcript of Jodi Arias’ closed-door testimony until after Arizona’s high court made a decision on Arias’ request to pause the retrial.

    Stephens ordered the courtroom closed during Arias’ testimony because she said Arias was nervous and wouldn’t testify unless the courtroom was closed to the press.

    With Jodi Arias’ bid to pause the trial denied on Thursday, her transcripts are one step closer to being released and the sentencing trial proceeded as scheduled.

    There are now reports that the judge could rule on Monday whether or not Jodi Arias will live life in prison or be sentenced to death.

    Jodi Arias’ defense attorney, Kirk Nurmi, made a last-ditch effort to have the prosecution’s intent to seek the death penalty thrown out, but failed to convince the judge of his accusations of prosecutorial misconduct and an inability to get witnesses to testify on Arias’ behalf.

    Judge Stephens said she would likely rule on Monday.
