Yahoo Sued Over Yahoo Group

Yahoo is being sued by the parents of a child whose nude photos were posted on a Yahoo Group, blaming Yahoo for knowingly allowing a pedophile a forum for his criminal actions.

The idea is, of course, obsurd, that Yahoo is liable for the actions of a user, Mark Bates, who set up the “Candyman” child porn trading group, which operated for a mere two months before Yahoo swooped in and shut it down.

Since the law clearly exonerates service providers from the crimes of service users, the parents would have to somehow prove that at some point during those two months, Yahoo knew about the group and allowed it to flourish, as it were. Yahoo and the convicted pedophile are co-defendants in the case.

In the interests of non-impartiality, I say good luck finding a jury stupid enough to blame Yahoo for this. As Techdirt says, while the things done to the child are obviously terrible, it is still disgusting that this family is trying to make a buck off of the biggest company it could find.
