New evidence leads to "buyer's remorse"Although the two sides signed a settlement of ConnectU's suit against Facebook, ConnectU claims new evidence merits an end to that agreement.
When ConnectU's founders, Tyler and Cameron Winklevoss, brought Mark Zuckerberg on to code their site at Harvard, they didn't expect Zuckerberg to emerge from the project with a rival site. Claims by ConnectU of infringement by Zuckerberg appeared to end in February when they agreed to a settlement.
However, Bloomberg said ConnectU's computer forensic investigator recently discovered new evidence in the form of old instant messages that allegedly back the claim against Facebook.
ConnectU now wants out of the settlement, as their lawyer claimed enforcement of those terms will lead to a new case and accusations of fraud against Facebook. The presiding judge failed to be impressed by this latest revelation.
"The parties chose to do what they did based on imperfect knowledge of what the outcome of the case might be," Bloomberg cited U.S. District Judge Douglas Woodlock as saying. "You knew at the time you entered into the agreement it wasn't complete."
There appears to be some question as to whether or not ConnectU's investigator should have brought the instant messages to the company's attention. He reportedly was not allowed to disclose anything other than code he reviewed on Facebook's computers.
Silicon Alley Insider prodded the attorney for ConnectU on the contents of the instant messages discovered in the investigation. Lawyer John Hornick said ConnectU didn't have the IMs in question.
They probably should have tried to reach D. Michael Underhill instead of Hornick. CNET said ConnectU hired Underhill to represent them in the still-ongoing dispute with Facebook.

Facebook is on a sucide path.
Lately it seem Facebook is trying it's level best to kill itself. First they removed the Marketplace and then the Wall vanished. Many of my friends have stopped visiting Facebook including myself as there is hardly anything left on Facebook except those idotic applications. I wonder what do people do on facebook now. Lastly, I pray to god may good sense prevail on facebook management and they bring back the good old facebook.
Facebook
Facebook, Twiter , Digg, and all those stupid sites are for spammers and immature morons who haven't grown up yet, even if old. No wonder they can't monetize it. Get a life you people or a woman/man. Do some sandwich parties. This country is racing fags as kids.

If you are truly mature, please show us by using proper grammer and spelling. Unless you really believe we are "racing fags as kids". Not everyone understand slang. Please be an adult if you expect anyone to read your comments.
greed
Sounds like greed and ConnectU needs to move on. If Facebook was just an ordinary site, do you think there would be a lawsuit!?
Facebook vs ConnectU Challenge?
There seems to be sign of envy and greed...
There was already settlement, then what's the purpose
of this new challenge?
To claim for another bucks for another settlement?...
Even Mark Zuckerberg borrowed some idea and
concepts of Facebook, he is still a visionary.
FACEBOOK is horrible
HIGH time somone shut down the phony STALINIST facebook. It simply doesn't work and its all kindergarten stuff. I doubt that even kids would be able to tolerate it.
I'm pretty sure Facebook is
Facebook is an amazing
Facebook is an amazing social networking tool. I would not be nearly as connected to my friends back in the states if it werent for their service. It has also helped me network and keep in closer touch with friends here in Argentina, where I now reside.
Money, money & money
Sometimes I really get sick of these people. Everything is about money, money and money! I wished it was possible for those companies have an insurance, like a car insurance. So they wouldn't be in court this much!
