			<content:encoded><![CDATA[<p>Google&rsquo;s not one to hold a grudge; today, Google.de features a logo celebrating Germany&rsquo;s 1990 reunification.&nbsp; But yesterday, a German court fined the search giant a little more than $14,000 for using the m.gmail.com domain for mobile search.</p>
<p><span id="more-40843"></span> Google&rsquo;s not going to go bankrupt due to this development.&nbsp; The decision won&rsquo;t even lessen the chances of Google&rsquo;s stock <a title="&quot;Google to $2,000 a Share?*&quot;" href="http://www.alleyinsider.com/2007/10/google-to-2000-.html">hitting $2,000 per share</a> (we&rsquo;ll leave the discussion of those chances for another time).&nbsp; Still, the search giant can&rsquo;t be turning cartwheels over the fine.</p>
<p>It&rsquo;s basically a case of adding financial insult to injury.&nbsp; As our own <a title="&quot;Gmail Suffers German Travails&quot;" href="http://www.webpronews.com/topnews/2007/06/23/gmail-suffers-german-travails">David Utter</a> reported several months ago, Google lost a court case involving the Gmail name, and this reduced it to using the term &ldquo;Googlemail.&rdquo;&nbsp; It looked as if Google might actually pull out of Germany over the verdict.</p>
<p>We now know that didn&rsquo;t happen, of course, but it seems that Google forgot (or &ldquo;forgot&rdquo;) to obey the ruling as it might apply to mobile search.&nbsp; Hence the fresh $14,000 fine.&nbsp; Yet, as today&rsquo;s Google doodle proves, the company&rsquo;s not taking the matter too hard.</p>
<p>Also, in a statement provided by <a title="&quot;Google Ordered To Pay $14,000 In Germany Over Gmail Trademark&quot;" href="http://searchengineland.com/071003-090656.php">Barry Schwartz</a>, the company said, &ldquo;We will pay the money to the German State as required by the Court of Appeal in Hamburg.&nbsp; We now use &lsquo;Googlemail&rsquo; across Germany and believe our users are very happy both with the name and the service.&rdquo;</p>
<p>The German government may not be so happy with anything involving Google &#8211; the existence of the <a title="Theseus Aid Gets EU Authorization" href="http://www.webpronews.com/topnews/2007/07/19/theseus-aid-gets-eu-authorization">Theseus project</a> supports this theory.&nbsp; Still, for the time being, it looks as if everything&rsquo;s quieting down.</p></p>

<p>Google might take its Gmail bat and ball, and go home. The company has faced a couple of recent setbacks with Gmail in Germany. Google could shutter the service there in the wake of those events.</p>
<p>A long-running trademark battle between Google and Daniel Giersch ended in victory for the German venture capitalist. <a href="http://news.com.com/8301-10784_3-9733667-7.html?part=rss&amp;subj=news&amp;tag=2547-1_3-0-5">CNET</a> said a German appeals court ruled against Google.</p>
<p>Google had to <a href="http://www.webpronews.com/topnews/2005/10/19/google-renames-gmail-in-uk">rename Gmail to Googlemail</a> in the United Kingdom to satisfy trademark claims there.</p>
<p>More bad news from Germany came in the form of new legislation. <a href="http://blog.outer-court.com/archive/2007-06-23-n52.html">Google Blogoscoped</a> said a newly passed law on record-keeping has Google making noises about pulling Gmail out of the country.</p>
<p>Philipp Lenssen cited Google&#8217;s Peter Fleischer and his comments in Heise regarding the law&#8217;s provisions, which would require Google to obtain and possibly verify names and addresses for those who wish to sign up for Gmail:</p>
<blockquote><p><em>Peter says, &quot;Many users around the globe make use of this anonymity to defend themselves from spam, or government repression of free speech &#8230; If the web community won&rsquo;t trust us with handling their data with great care, we&rsquo;ll go down in no time.&quot; </em></p>
<p><em>Peter added that a German-only solution for tighter control of email data isn&rsquo;t useful in the first place, because people might simply escape to foreign email service providers.</em></p>

<p>Google faces the prospect of having Germany challenge them to pull Gmail out of the country. How successful that gambit will be depends on how much Google values its prospects in Germany. If they feel success in China or Korea is within reach, Google could opt to focus on those markets and write off Germany as a loss.</p>
