Can-Spam Does Not Require Direct Consent
On 6 B in the article- The statement about the CAN-SPAM Act is innacurate. CAN-SPAM actually created an email marketplace in the United States where you can send commercial email to consumers without permission. In almost every other country, you do need direct consent to send a commercial message, except in some cases where a previous commercial relationship already exists.
Regardless, getting permission is a best practice, but not the law in the United States. While you do not need permission, you do need to be compliant with 9 major points of the CAN-SPAM Act, the most important of which is that you respect a consumer's request to unsubscribe from your list.
