I think it was David Barry who suggested that Justice Potter Stewart's comment about pornography, 'I know it when I see it,' resulted in a tonne of potential porn's being dropped off on his lawn for evaluation....

But his point is a valid one: judging whether an image is offensive or pornographic is a very subjective judgement, but there are some rough lines that most people will agree about. By contrast, there is no way for a scene intrinsically 'look copyrighted'---yes, production company logos and high production values are decent indicators, but nowhere near as certain markers.

I agree, people there, in the aggregate, care a lot more about offensive content and porn than about copyrightedness, but I'm just saying that it's not sheer disingenuousness on YouTube's part.

Both are socially constructed classes, but one is more visceral than the other.
