Jim Finucan Answers Debt-Collection Questions

collection settlement

Hello,

I made a settlement agreement with a collection company about 6 months ago.  I would pay them a certain amount monthly, which they could withdraw from my checking account automatically each month and after 6 cleared, timely payments, the debt would be paid off.  I made my final payment on 9/15 and less than a week later received a letter from another collection company for the balance of the account.  Call me ignorant, but isn't that fraud?  What can I do to take care of this situation?  The former company is insisting that the debt was recalled by the original company and given to someone else and there is nothing they can do.  Any advice would be appreciated.

Thank you

Collection agency

My name is Curtis Smith. I work for a collection agency in Florida called www.controldatainc.com . What I would suggest is check with your bank. Most people don't know this, but automatic withdrawes and check by phones and be "charged back" up to 1 year.  Once you have your money back I would call the new agency and work out a new settlement agreement with them. Remember to get everything in writting.

statute of limitations

I just received a bill from a collection agency from my divorce in 1990.

It was from The Common Pleas  Court.

is there a statute of limitations on this bill being  18 years old?

 thanks, Tom
