Defamation

It's not about having the right to a decent page rank, it's about the right to have an objectively produced pagerank by the same unbiased automatic algorithm that other sites enjoy.

KinderStart's rank was reduced to 0 by manual means and is therefore defamation. Unfortunately the judge couldn't decide the 0 rank was manually produced and so the defamation charge failed, but warning was given that it could succeed in other cases. That would include sites banned outright which are also set to rank zero but don't exist in the index. New sites are given 'unranked' status rather than a 0 so there is clear proof of defamation for banned sites. KinderStart was not banned.
