Eli Lilly and Company announced that the U.S. District Court for the Southern District of Indiana has stated that Judge Richard Young will render his decision…

…on Thursday, April 14, 2005 at 5:50 p.m. Eastern Daylight Savings Time in the Zyprexa patent case of Eli Lilly and Company v. Zenith Goldline Pharmaceuticals et al.

According to an article from TheStreet.com:

“Lilly’s shares were up 84 cents, or 1.6%, to $54.66, as the stock spiked just after the company announced the judge will rule on the patent challenge.

Shares of the challengers also climbed after the announcement. Ivax’s stock was up 41 cents, or 2.2%, to $18.80; Dr. Reddy’s shares gained 4 cents to $17.49; and shares of Teva, which dropped early in the day, gained back some ground and were off 6 cents to $32.20.”

Lilly remains confident Zyprexa’s compound patent is valid and the generic manufacturers’ claims are without merit. Although the company cannot predict the outcome or make guarantees of success in this litigation, Lilly continues to expect to prevail.
